Challenges Ahead for Ethereum Spot ETFs: SEC Likely to Deny Applications on May 23

The Securities and Exchange Commission is expected to deny applications for Ethereum spot exchange-traded funds on May 23, according to analysts. The lack of meaningful interaction with prospective issuers, combined with Ethereum’s unclear regulatory status and a recent investigation into the Ethereum Foundation, have led experts to believe that approval is unlikely.

If rejected, prospective ETF issuers such as BlackRock, Fidelity, and Ark Invest have two options: either sue the SEC, as Grayscale did for Bitcoin spot ETFs, or reapply at a later date. The upcoming US election could also play a role in the approval process, as a new president could lead to a change in SEC leadership that may be more favorable towards crypto.

While Grayscale successfully sued the SEC for Bitcoin ETF approval, analysts believe that this strategy may not be replicated for Ethereum ETFs. Lawsuits are costly and time-consuming, and other issuers may be hesitant to anger the SEC. However, the election could provide a solution, with a new chair potentially being appointed in April or May, leading to a decision on Ethereum ETFs by the end of 2025.
